Folsom Bluffs Owners Association Rules and Regulations ======================================================== Folsom Bluffs is a Planned Unit Development governed by a set of BY-LAWS and by a DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS called CC&R's. The BY-LAWS set forth the manner in which the Folsom Bluffs Owners Association is organized and operated by its elected Board of Directors. The CC&R's describes the basic rights and responsibilities of the individual members of the Association and those of the Association as a whole. The CC&R's also list a number of use restrictions that apply to the common areas and the individual units at Folsom Bluffs. These restrictions are designed to safeguard the appearance of the property and enhance property values for the benefit of all owners; they form the basis of these Rules and Regulations. Section 6.10 of the CC&R's grants the Board of Directors the authority to establish additional rules and to set penalties for recurrent violations.
Owners who rent their units are advised to provide a copy of these Rules and Regulations to all prospective tenants. To wait until a lease is signed is often too late to avoid some serious misunderstandings about the restrictions on parking and pets, for example, which can lead to major problems. It is also recommended that you incorporate a copy of these rules and Regulations into the actual lease by addendum or by reference. Failure to do so could invalidate your lease based on your failure to disclose fully relevant information about the property.
The first page of what follows contains a summary of what the Association provides in the way of maintenance and what is the responsibility of the individual owner. After that come the Rules and Regulations. And finally there is a statement of the procedure owners and residents should use in filing a complaint. References in parenthese are to relevant sections of the CC&Rs.
These pages should be kept in your permanent files with all the other documents pertaining to your ownership of property at Folsom Bluffs.
State and Federal Fair Housing Laws =================================== If the Rules and Regulations contains any restriction based on race, color, religion, sex, familial status, marital status, disability, national origin or ancestry, that restriction violates state and federal fair housing laws and is void, and may be removed pursuant to Section 12956.1 of the Government Code. Lawful restrictions under state and federal law on the age of occupants in senior housing or housing for older persons shall not be construed as restrictions based on familial status.
======================================================== GENERAL AREAS OF MAINTENANCE RESPONSIBILITY.
I. ASSOCIATION RESPONSIBILITIES (Article VI Sec. 1 and 2) ========================================================
A. Roofs. To repair and maintain the roofs.
B. Exterior building surfaces excluding atriums. To paint, repair, replace, and maintain exterior building surfaces, flashing and wood trim, with the exception of exterior surfaces within the atriums as spelled out in the CC&Rs amendment of 1999. The Association is NOT responsible for doors, window units, or siding damage caused by attachment of decks.
C. Insurance. The Association maintains a fire and extended coverage policy on the structures and public liability policy covering the common areas. There is no insurance protection against flood or earthquake and no coverage for the personal property of residents. All owners and residents should consult with their own insurance agent regarding their insurance needs and the types and amounts of insurance they should purchase to protect their personal possessions and interests.
D. All fences and retaining walls.
II. Homeowner Responsibilities (Article VI Sec. 3) ===================================================
A. Clean, repair and replace all window units and doors, including garage doors. Window screens are the responsibility of owners and must be of the original color.
B. All structural pest control repairs, unless caused by some negligence on the part of the Association, according to the Civil Code provisions for Planned Unit Developments.
C. Repair, replace, and care for all landscape improvements, including sprinkler systems, inside any fenced patio areas.
D. The costs to repair replace and maintain party walls are the shared responsibility of the two owners sharing the party wall.
E. Repair, replace, and maintain all decks and repair all damaged caused by the attachment of decks to the building. Any changes or modification to a deck require approval of the Architectural Control Committee. A clear wood preservative may be used on decks. The board has also approved (Board minutes November 4, 2002)Olympic brand, Oxford Brown, opaque deck stain.
F. Repair and maintain all utility lines in the unit.
RULES AND REGULATIONS =====================
I. TRAFFIC AND PARKING (Article VII, Sec 13)
A. Crestridge Lane is a private residential street. All owners, residents, and guests shall use Crestridge Lane in a safe manner. The Folsom Police Department recommends a 15-MPH speed limit. Anyone driving in an unsafe manner or at an excessive rate of speed will be subject to a fine.
B. Parking. Every resident at Folsom Bluffs shall use the double garage for parking any and all vehicles owned or driven by the resident.
C. Households with 3 licensed drivers and a third vehicle, or with 4 licensed drivers and a fourth vehicle shall park two vehicles in the garage and make application to the Board of Directors for a permit to park the third vehicle (and fourth vehicle, if applicable) in visitors parking at the entry to Folsom Bluffs.
D. Parking Permits. There will be a $50 yearly fee for each vehicle allowed to use visitor parking. This fee will be used to maintain the parking areas.
E. Third and fourth vehicles obtaining permission to use visitor parking must be in regular daily use. Visitor parking is not to be used for storing vehicles. Vehicles without current registration or which are in an inoperable condition will not be permitted in visitor parking and will be subject to tow at owner's expense.
F. Vehicles permitted to use the entry parking area must display the Association parking permit on the left rear bumper.
G. Driveway Parking. Only temporary visitors may park in the driveways. Residents must notify management if a visitor will be staying in excess of 7 days within any 30-day period.
H. No resident shall use the street, driveway, or any portion of the common area for the parking or storing of any motor home, boat, recreational vehicle, or commercial vehicle. Exception: recreational vehicles may park in a driveway for loading and unloading purposes only between the hours of 8:00 a.m. and 5:00 p.m.
I. Garage doors are to remain closed at all times, unless a resident is entering or leaving the garage or working in the garage.
J. No repair work on motor vehicles is permitted on common areas.
II PETS (Article VII Sec 6) ===========================
A. Dogs, cats, or other usual domestic animal may be kept, provided that they are not kept for commercial purposes and do not constitute a nuisance to other residents.
B. Except as provided above, animals, livestock, and poultry shall not be kept, raised or bred.
C. Pets shall be kept within enclosed areas of the homes. They shall not be let out unattended or allowed to run lose.
D. Dogs shall be kept on leashes when taken for walks in the common area.
E. Pets shall not be permitted to foul the common area. Pet owners are responsible for cleaning up promptly after their pets and for disposing of the waste in a sanitary manner. Violations are subject to immediate fines.
F. Residents shall not permit their pets to create excessive noise at any time.
G. All pets shall be licensed and vaccinated as required by law.
H. No resident shall have more than two (2) four-legged animals.
III SWIMMINMG POOL ==================
A. The Folsom Bluffs pool is for the exclusive use of owners, residents, and their guests. Guests must at all times be accompanied by a resident. Residents are expected to show discretion regarding the number of guests at the pool.
B. No animals are allowed in the pool area at any time.
C. For safety reasons children under the age of 14 should be accompanied by an adult at all times. (This is a health code guideline.)
D. Pool and pool area hours are from 6:00a.m. to 10:30 p.m. Courtesy regarding noise shall prevail.
E. Mechanical equipment is to be handled by qualified pool maintenance personnel only.
F. No glass objects will be permitted in the pool area.
G. Life saving equipment is for emergency use only. It is not to be played with or removed from the pool area.
H. No roughhousing in or around the pool. No running, jumping or cannonballing is permitted.
I. the pool is not large enough to accommodate floating rafts or inner tubes.
J. Longhaired swimmers are requested to use a bathing cap or to secure their hair in a braid or some other fashion.
K. "Cut-offs" are prohibited in the pool. Loose threads can damage the filtration system.
L. Everyone using the pool is expected to clean up all of their trash and deposit it in appropriate containers
before leaving the pool area. All pool furniture should be neatly arranged before leaving the area. In addition, all lights in the restrooms should be turned off.
M. Access to the pool is through a locked gate. Please keep this gate locked at all times. Replacement keys cost $10 and may be obtained by contacting a member of the Board.
IV. MISCELLANEOUS REGULATIONS. ==============================
A. Residents at Folsom Bluffs must live in close proximity to one another. Special consideration must be shown to reduce noise between the hours of 10:30 p.m. and 8:30 a.m.
B. Social gatherings by residents will not be discouraged. However, residents sponsoring social events are expected to be considerate of their neighbors. Frequent noisy or disruptive parties by any resident cannot be tolerated.
C. Garbage containers must be kept out of sight, except on days of pick-up. Containers must be put back out of sight by evening of pick-up day.
D. No "For Sale" or "For Rent" signs shall be placed on the common area. All real estate signs, not to exceed 432-sq. in., are to be mounted flush on the front of the garage of the unit being advertised. Exception: freestanding signs may be placed on the common are when a Realtor is holding an "Open House."
E. It is important that exterior garage lights be kept in working order, since they provide all of the street lighting at Folsom Bluffs. It is a County requirement that house numbers be lighted for emergency vehicles. Residents are responsible for replacing burned out light bulbs promptly and for repairing any electrical problem quickly. These lights are controlled by a light sensor installed in each garage. Replacement and repair of this sensor is the owner's responsibility.
F. Holiday decorations are encouraged during holiday seasons. These decorations must be removed within a reasonable time following the end of the holiday season.
G. No fireworks are permitted at Folsom Bluffs at any time for any occasion. The fire hazard is too great.
V.COMPLAINT PROCEDURE =====================
A. Please submit all complaints regarding violations of these Rules and Regulations or other matters to management.

B. Management will notify the owner (and tenant, if there is one) of the nature of the violation and of the corrective measures necessary. Reasonable time will be allowed to take this corrective action. An uncorrected or recurring violation is subject to a $50 fine. Subsequent fines for the same infractions will be $100.
C. Any resident involved in a parking violation will receive tow (2) written notices. If the violation continues, the vehicle9s0 involved will be subject to tow and the owner will be fined $50, $100 for subsequent violations.
D. An owner who receives a notice of a fine has the right to appeal the fine at the next regularly scheduled meeting of the Board of Directors. The desire to appeal the fine must be stated in writing and mailed to management or to the Board within 15 days of issuance of the fine. Unappealed fines become due and payable on the first day of t he next month following notice of the fine. Appealed fines, which are upheld by the Board become due and payable the fist day of the month following the date of the appeal. Unpaid fines are subject to all applicable late charges and interest.
E. Because of health and safety considerations certain violations will result in an immediate fine without prior notice. Such violations are noted in the text of the Rules and Regulations.
F. Fines for first offense will be $50. Subsequent offenses will be fined at the rate of $100 per occurrence. Some offense will have the cost of clean up or repair added to the amount of the fine.
