FOLSOM BLUFFS OWNERS ASSOCIATION
RULES AND REGULATIONS
AS OF JUNE 2009

Folsom Bluffs is a Planned Unit Development governed by a set of BY-LAWS and by a DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS. The BY-LAWS set forth the manner in which the Folsom Bluffs Owners Association is organized and operated by its elected Board of Directors. The DECLARATION, more commonly know as the CC&Rs, describes the basic rights and responsibilities of the individual members of the Association and those of the Association as a whole. The CC&Rs also list a number of use restrictions which apply to the common areas and the individual units at Folsom Bluffs. These restrictions are designed to safeguard the appearance of the property and enhance property values for the benefit of all owners; they form the basis of these Rules and Regulations. Article 2 Section 2.5 of the CC&Rs grants the Board of Directors the authority to establish additional rules and to set penalties for recurrent violations.

As stated in Article 4, Section 17 Owners who rent their units must provide a copy of these Rules and Regulations to all prospective tenants. Refer to section 4.17.1 if you are planning on renting your unit. To wait until a lease is signed is often too late to avoid serious misunderstandings about the restrictions on parking and pets, for example, which can lead to major problems. It is also recommended that you incorporate a copy of these Rules and Regulations into the actual lease by addendum or by reference. Failure to do so could invalidate your lease based on your failure to disclose fully relevant information about the property. Management must also receive a copy of all lease agreements. Please remember, you must apply for approval to rent your unit.

These pages should be kept in your permanent files with all the other documents pertaining to your ownership of property at Folsom Bluffs.

If this document contains any restriction based on race, color, religion, sex, familial status, martial status, disability, national origin ancestry, that restriction violates state and federal fair housing laws and is void, and may be removed pursuant to Section 12956.1 of the Government Code. Lawful restrictions under state and federal law on the age of occupants in senior housing or housing for older persons shall not be construed as restrictions based on familial status.



RULES AND REGULATIONS

I. TRAFFIC AND VEHICLE(S) PARKING Article 4 Section 4.12

A. Crestridge Lane is a private residential street. All owners, residents, and guests shall use Crestridge Lane in a safe manner. The Folsom Police Department recommends a 15 MPH speed limit. Anyone driving in an unsafe manner or excessive rate of speed may be subject to disciplinary action or a monetary fine.
B. Parking. Every resident at Folsom Bluffs shall use the double garage for parking any and all vehicles owned or driven by the resident.
C. Driveway Parking. Only temporary visitors may park in the driveways. Residents must notify management in writing if a visitor will be staying in excess of 7 days within any 30 day period.
D. No resident shall use the street, driveway, or any portion of the common area for the parking or storing of any motor home, boat, recreational vehicle, or commercial vehicle. Vehicles may park in a driveway for loading and unloading purposes between the hours of 8:00AM and 5:00 PM. Or for a temporary block of time up to 4 hour period.
E. Garage doors are to remain closed at all times, unless a resident is entering or leaving the garage or working in the garage.
F. No repair work on motor vehicles is permitted on common areas.
G. If a visitor establishes a pattern of visitation at the sole discretion of the Board, that visitor(s) may be deemed a resident.
H. No resident shall use the visitor parking.

ANIMALS Article 4 Section 4.16

A. Dogs, cats or other usual domestic animals may be kept, provided that they are not kept for commercial purposes and do not constitute a nuisance to other residents.
B. Except as provided above, animals, livestock, and poultry shall not be kept, raised or bred.
C. Pets shall be kept within enclosed areas of the homes. They shall not be let out unattended or allowed to run loose.
D. Dogs shall be kept on leashes when taken for walks in the common area.
E. Pets shall not be permitted to foul the common area. Pet owners are responsible for cleaning up promptly after their pets and for disposing of the waste in a sanitary manner. Violations maybe subject to disciplinary action and or a monetary fine.
F. Residents shall not permit their pets to create consistent or excessive noise at any time.
G. All pets shall be licensed and vaccinated as required by law.
H. No resident shall have more than two (2) four-legged animals.
I. Folsom Bluffs does not allow an aggressive breed dog within the community.

II. SWIMMING POOL.
A. The Folsom Bluffs pool is for the exclusive use of owners, residents, and their guests. Residents are expected to show discretion regarding the number of guests at the pool.
B. No animals are allowed in the pool at any time.
C. For safety reasons children under the age of 14 should be accompanied by an adult at all times. No life guards.
D. Pool and pool area hours 6:00am to 10:00pm. Courtesy regarding noise shall prevail. Pool Season April 21- October 21.
E. Mechanical equipment is to be handled by qualified pool maintenance personnel only.
F. No glass objects will be permitted in the pool area.
G. Life saving equipment is for emergency use only. It is not to be played with or removed form the pool area.
H. No roughhousing in or around the pool. No running, jumping or cannon-balling is permitted by any resident or visitor.
I. The pool is not large enough to accommodate floating rafts or inner tubes.
J. Appropriate pool attire required.
K. Everyone using the pool is expected to clean up all their trash and deposit it in the appropriate containers before leaving the pool area. All pool furniture should be neatly arranged before leaving the area. In addition, as a courtesy, all lights in the restroom should be turned off after use.
L. Access to the pool is through a locked gate. Please keep this gate locked at all times. Replacement keys cost $10 and may be obtained by contacting Management.
M. No homeowner shall use the pool during an Association Meeting of the Membership or function approved by the Board of Directors.

III. MISCELLANOUS REGULATIONS.

A. Due to our close proximity, special consideration must be shown to reduce noise between the hours of 10PM and 9AM.
B. Social gatherings by residents will not be discouraged. However, residents sponsoring social events are expected to be considerate of their neighbors. Frequent noisy or disruptive parties by any resident cannot be tolerated.
C. Garbage containers must be kept out of sight, except on days of pick-up. Containers must be put back out of sight by evening or pick-up day.
D. No “For Sale” or “For Rent” signs shall be placed on the common area. All real estate signs, not to exceed 432 sq. in., are to be mounted flush on the front of the garage of the unit being advertised. Exception: freestanding signs may be placed on the common area when a realtor is holding an “Open House.”
E. It is important that exterior garage lights be kept in working order, since they provide all of the street lighting at Folsom Bluffs. It is a County requirement that house numbers be lighted for emergency vehicles. Residents are responsible for replacing burned out light bulbs promptly and for repairing any electrical problem quickly. These lights are controlled by a light sensor installed in each garage. Replacement and repair of this sensor is the owner’s responsibility.
F. Holiday decorations are encouraged during holiday seasons. These decorations must be removed within a reasonable time following the end of the holiday season. (January 15th)
G. No fireworks are permitted at Folsom Bluffs at any time for any occasion. The fire hazard is too great.

IV. COMPLAINT PROCEDURE.

A. Please submit all complaints regarding violations of these Rules and Regulations or other matters to management:

B. Management will notify the owner (and tenant, if there is one) of the nature of the violation and of the corrective measures necessary. Reasonable time will be allowed to take this corrective action. An uncorrected or recurring violation is subject to a $50 fine. Subsequent fines for the same infraction will be $100.
C. Any resident involved in a parking violation will receive two (2) written notices. If the violation continues, the vehicle(s) involved may be subject to tow and the owner will be fined $50 to $100 for subsequent violations.
D. An owner who receives a notice of fine has the right to appeal the fine at the next regularly scheduled meeting of the Board of Directors. The desire to appeal the fine must be stated in writing and mailed to management or the Board within 15 days of issuance of the fine. Un-appealed fines which are upheld by the Board become due and payable the first day of the month following the date of the appeal. Unpaid fines are subject to all applicable late charges and interest.
E. Because of health and safety considerations certain violations will result in an immediate fine without prior notice. Such violations are noted in the text of the Rules and Regulations.
F. Fines for first offenses will be $50. Subsequent offenses will be fined at the rate of $100 per occurrence. Some offenses will have the cost of clean up or repair added to the amount of the fine.


FOLSOM BLUFFS HOMEOWNERS
ASSOCIATION FINE POLICY

I. Fine schedule - up to $50 per daily infraction of the governing documents.

II. The Association adopts a six month enforcement period. Once a specific infraction of the governing documents has been reported and a warning issued, no additional warnings will be issued for further infractions of the same rule during the next six months. A second infraction of the same nature as the first will result in the Association taking immediate corrective steps such as hiring a contract service to perform the requested maintenance or scheduling a hearing before the Board of Directors.

III. First report of an infraction of the Association’s governing documents from any source results in a warning letter to the homeowner. The warning letter will state the nature of the infraction and request compliance within a specified time period.

IV. Once the warning period expires, further infractions of the same nature fall into one of the two categories:

A. Infractions that require maintenance. These infractions will result in the Association hiring a contract service to perform the maintenance. The Association will pay the invoice and request the homeowner reimburse the Association with 15 days. If reimbursement is not received by the due date, the Association will call the homeowner to a hearing at which the Board may impose a special individual assessment against the lot in the amount of the outstanding invoice. From this point on, the matter falls under the Associations’ already established collection policy.
B. Infractions that require action be taken the homeowner. A second infraction of this nature will result in the homeowner being called to a hearing before the Board of Directors at which time a special individual assessment may be levied. However, to call a homeowner into a hearing under these circumstances will require that either two individual lot owners report the same violation; or, a management representative witnesses the violation.


Architectural Summary
AN ARCHITECTURAL APPLICATION MUST BE COMPLETED, SUBMITTED AND APPROVED PRIOR TO THE START OF ANY EXTERIOR / INTERIOR CHANGES. ANY IMPROVEMENTS MADE WITHOUT PRIOR APPROVAL MAY RESULT IN A MAINTENANCE ASSESSMENT FOR REMOVAL OR CORRECTION IF NECESSARY. ANY "LIKE" FOR LIKE REOUESTS WILL BE FAST TRACKED FOR APPROVAL BY THE ARCHITECTURAL COMMITTEE AND MAY NOT REOUIRE BOARD APPROVAL.
1. Exterior Paint & Siding -Homeowners can use T 1-11 or Hardie Board Sierra 8 Panel is acceptable. Hardie Board can be pre-painted or primed and painted on-site. Exterior Paint Colors have been pre-selected to follow the "Village Color Scheme". These approved base paint colors are as follows: Cobblestone, Monterey Taupe and Woodstock Brown.
2. Community "Color Scheme" - All owners will be required to re-paint their house within a five year period of time. The current community color is Cobblestone; you will be required to re-paint within the new color scheme. However, Cobblestone is one of the selected colors so that you may easily re-paint your home if so desired to this color. Each owner will choose from a grouping of color options. Based on upon the community scheme available on the website at www.Folsombluffs.org.
3. Light for front of garage and side garage is: Bel Air Rust (Bronze color). The association has pre-selected the light fixture to be used (see enclosed photo). The existing lights will be replaced by the association; owners may select the same fixture for their interior patio or chose from any style in a black, brown or bronze finish.
4. Deck product can be redwood (clear stain) and / or Trex (color approval by architectural committee) Deck trim (railings, etc.) can be redwood or deck composite brand.
5. Garden or flat windows are acceptable. All glass replacements must meet current city code requirements. No decorative windows, detailing or grids allowed.
6. Sliding doors can be replaced with French doors no detailing or grids allowed.
7. Windows can be metal or vinyl – color Bronze.
8. Roof replacement must be with tile (lightweight or regular) and must match current roof color. Samples must be submitted with application for consideration of approval. Any requests submitted without a proposed sample will be returned to the owner as incomplete.
9. Front doors may wither be a natural wood finish or must be painted to match the approved trim color corresponding with the color of the house.
10. Security doors – If you are planning on the addition of a security door please submit two selections along with the required forms to management. All security doors require approval from the Architectural Committee prior to installation.
11. Neighbor’s approval is required as a component of the Architectural Approval form.

Re: Architectural Review Procedure
On behalf of Folsom Bluffs Homeowners Association we have created a system that will help your architectural review process go as smoothly as possible.
Please complete the enclosed architectural application. All improvements, replacements, etc. need to be submitted and approved prior to the start of any exterior / interior changes. Any improvements made without prior approval may result in a maintenance assessment for removal or correction if necessary. Any "like" for like requests will be fast tracked for approval by the Architectural Committee and may not require board approval.
The Architectural Committee does have some approval authority. However, most requests will be presented to the board for final approval. Please refer to Article 8 of the CC&R's.
Design Review procedure:
1. We have included an application for your request( s).
2. Please Read through the "Architectural Summary" Including the section named "Community Color Scheme".
3. Make sure that you have pulled the required permits with the city and! or are in compliance with city code.
4. Please sign the bottom of this letter acknowledging that you have read it.
* Please note that any incomplete information will be denied. Also, if the committee denies your plans for any other reasons, you will have to start the submittal process over again.
* Please include any brochures, drawings, photos, and samples as it pertains to your project.
